2023.05.28 18:32 RBZL FAA Investigations for Pilot Deviations: Everything you never knew you wanted to know!

Hey everyone. As a bit of background, I'm a former FAA Aviation Safety Inspector (ASI). No, I'm not your_friendly_asi, though I've communicated with them. I've previously posted about my path to 1500 hours, and I've made incognito comments about what the FAA is or isn't likely do while I was employed as an ASI. However, the FAA's social media policy is both ambiguous and strict, so I was careful about what I said. Now that I'm no longer employed, I'm comfortable sharing a bit more about the ASI job, and what the FAA (either as an agency, as a FSDO, or as an individual ASI) is likely to do in certain circumstances.
Of course, one of the biggest concerns as a pilot is what happens when you become the subject of a FAA investigation, whether you were the one that screwed something up or you were caught by proxy (i.e. as someone's instructor). There are a lot of misconceptions among the pilot community about what's going to happen to you, and what you need to do. So, let's talk about it!
Obligatory note that I am no longer employed with the Federal government of the FAA, and that the information below is my personal viewpoint and not an official position of the FAA. All of this information is available publicly via FAA orders which dictate how investigations and deviations are handled. I'm not telling you anything secret or proprietary here. Also note that each FAA office can operate a little differently, but still be within the policies and guidance.

Why would the FAA investigate me?

The FAA is charged with investigating anything which falls within it's 9 "areas of responsibility", as mandated by Congress and 49 USC. See FAA order 8020.11, as revised. Those areas include the competency of FAA-certificated airmen, and violations of Federal Aviation Regulations (14 CFR). Therefore, if the FAA becomes aware that there is a possibility that you may have violated a regulation or that you might not be competent for whatever reason, the FAA is mandated to look into it.
You would probably find yourself in this situation after making some sort of error or mistake. It's not hard as a pilot to violate a regulation, if we're being perfectly honest. 91.123(a) is probably the most common violation - failure to comply with an ATC clearance. This is fairly all-encompassing. You could take a wrong turn during taxi, land on the wrong runway, get off your assigned altitude or route while IFR, or anything else you can think of which ATC instructed to do but you didn't for whatever reason. And this is just one single regulation in Part 91 - obviously there are hundreds of regulations in 14 CFR which you could potentially run afoul of, though ATC clearances are the most commonly investigated because ATC notices you deviated from your clearance and essentially snitches on you (not hating on them - more on that later).

How would I know I'm being investigated?

Ultimately, you'll know because eventually someone at the FAA will contact you. It will usually be an ASI. Depending on the source of the report and the workload of the ASI, you may not hear anything until a month or so after the event. The ASI may send you a formal Letter of Investigation (LOI), a Compliance Program and Pilot's Bill of Rights (CP & PBR) brochure, or they may just try to give you a phone call initially. ASIs CAN text you and email you! Many ASIs are issued cell phones, and nothing says they can't try to get a hold of you using any means. My process was to call the pilot and ask for an email address so that I could send some information that way, instead of needing to physically throw something in the snail mail. Policies can vary by each office, though.
If you mess something up and ATC issues you what's known as a Brasher warning (i.e. "possible pilot deviation" usually along with "I have a phone number for you to call"), it doesn't guarantee that you're going to end up being investigated. Depending on what happened, though, ATC may be required to submit something called a MOR, or a Mandatory Occurrence Report. So yes, ATC sometimes snitches on you, but they're required to for certain things. It can also be controller and facility dependent as to what they will file reports for - if a facility is seeing a lot of the same deviations/violations, they might start filing reports even if it's something minor in order to try to put some attention on it higher up. This report makes its way through the ATC chain until it is eventually forwarded to the FSDO with responsibility over the event. If you're a GA pilot, the FSDO covering the geographical area where you messed something up will investigate. If you're a certificate holder or fly for one (part 121, 135, etc), the report will go to the FSDO, CHDO, or CMO which manages that certificate. Routing all of this is a whole process, which is why it can take a month or more after the event to be contacted by the FAA.

An ASI contacted me after some sort of event happened... F*%#. Now what?

Straight to jail, obviously. Might as well cut up your certificates too, before they come pick you up. It will show the ASI that you feel bad about what you did, and that you respect his authoritah, which may lead to a reduced sentence.
Nah, you're probably one of about 12 PDs (Pilot Deviations) on the ASI's desk right now. Remember that whole mandate for the FAA to investigate certain things? The ASI is most likely not out to get you, he's just doing his bureaucratic job. Keep in mind that an ASI is also a pilot, holding at least a Commercial Pilot Certificate and meeting Airline Transport Pilot qualifications, and if he's a General Aviation Operations ASI he's also a current CFI with at least a few hundred hours of instructing. He's going to contact you as described above, send you the Pilot's Bill of Rights in some form, and probably try to schedule a time to talk with you about what happened. This will normally just be a phone call. The ASI might also ask you to provide copies of some things, like your logbooks showing that you were current and had the appropriate endorsements for the type of flight you were conducting. Your pilot and medical certificates can be looked up, but you may also be asked for copies of those to verify that you have them in your possession and that they match. Other things may be requested, as appropriate, depending on what exactly happened.
The purpose of the interview (phone call, or otherwise) is for the ASI to determine a few things: what happened, why it happened, if it was intentional, and why you are or aren't likely to do the same thing again. In short, the ASI is tasked with gathering all of the facts associated with the event, and performing a Root Cause Analysis to determine why whatever it is that happened did happen. Your input and perspective as the pilot is very important to this, because nobody knows what you were thinking or what you were seeing except you. Without your input, the ASI has to make a determination on what to do about the event with only the other limited information available.
The possible outcomes of this investigative process are typically: No Action, Compliance Action, Remedial Training via FAAST, 49 USC 44709 Reexamination, or Enforcement Action. There are also things called SNAAPs which are basically warning letters, but they aren't commonly used in most FSDOs for GA pilots. Ultimately, the ASI and the FSDO/CHDO/CMO is empowered to take any action which they feel will ensure continued safety of the National Airspace System.

Some of those outcomes don't sound encouraging. What's going to happen to me? Sounds like "straight to jail" is still on the table.

I'd say that over about 95% of the time, a PD is going to be resolved with Compliance Action. This is part of the FAA's new Compliance Program/Philosophy. I'd really recommend a quick read of FAA Order 8000.373, as it's only a page and a half and really sums up the point of the Compliance Program. If you get the CP & PBR brochure (see it here), it also explains the general idea. The FAA at one point figured out that to actually enhance aviation safety, they needed to obtain the perspective of pilots involved in deviations. Pilots aren't willing to share information which might be incriminating, though, if there is no incentive to do so. Why would you tattle on yourself if the FAA is just going to use that information to work on taking your certificate away via Enforcement Action?
The Compliance Program allows an ASI to resolve a probable regulatory violation or deviation without resorting to Enforcement Action. The potential corrective actions are pretty limitless and are at the discretion of the ASI and the office, but typically this is accomplished via Compliance Action Counseling. The ASI is going to review their Root Cause Analysis with you, and offer feedback and suggestions in order to help ensure that the situation does not occur again. This is normally done via a phone call, with a follow-up letter. For simple violations, half of the time I would simply complete counseling on the phone immediately after the interview with a pilot. Occasionally, Remedial Training would be suggested if a pilot was very rusty and the event involved something like a runway incursion where the consequenses were potentially more serious if things happened to go really sideways.
The thing with the Compliance Program is that the ASI needs to be confident that you also understand the root cause of the event, and that you are willing and able to comply with applicable regulations in the future. "Willing" means that you're willing to openly talk to the ASI about the event and share what happened, what you learned, and how you plan to mitigate against such a situation in the future, so you might want to think about that before your conversation. "Able" means that you are competent and proficient enough to exercise your privileges without invoking future violations, among other things. Entering into the interview conversation having already thought about the root causes, and what you've already done or are going to do to ensure that the event won't be a repeat occurrence will do a huge amount to assure the ASI that you are indeed willing and able to comply in the future.
If there is a serious question as to your competency, you might be looking at a 44709 reexamination ("709 Ride"). As most pilots know, this is essentially a checkride, or a portion thereof, conducted by the ASI to evaluate whatever Areas of Operation of the applicable ACS or PTS that you have been identified as potentially being deficient in. These are fairly rare, and generally only occur after things like accidents where a pilot's actions or story indicate that they really may not have known what they're doing. If you mess up an instrument approach in IMC reeeeally badly, ATC has to intervene repeatedly, and you don't think that you did anything wrong after the fact and that it was all ATC's fault, you may also be looking at a 709 ride, for example.
Enforcement Action is typically reserved for the most egregious violations, or violations where a pilot willingly and deliberately engaged in a violation or another sort of illegal activity. If you're flying with literally everything expired, both in terms of yourself and the airplane, and you're doing other dumb and illegal things during that flight like buzzing people or houses, there's no way that you shouldn't have known better. This is the process in which your certificates are in danger, or you're looking at civil penalties or criminal charges, as applicable. If you made an honest mistake, even if it resulted in a totaled airplane and a hospital stay, Enforcement Action is extremely unlikely because the Compliance Program is designed to handle most unintentional violations. Enforcement cases are also a huge workload and pain in the rear for both the ASI and the office.

So for each outcome, what does it mean in the end? Will it be on my record anywhere?

For Compliance Action, Remedial Training, and a successfully passed 709 Ride, typically, no. Once you successfully complete whatever the requirement is for you to return to compliance, you'll receive a letter stating that the FAA/ASI have determined there is no cause for further action and that you may consider the matter closed. These events don't show up on any record that the FAA would normally forward about you, i.e. in a PRIA request or via the Pilot Records Database. However, many aviation employers and airlines do now specifically ask if you have ever been the subject of a FAA investigation, a 44709 reexamination, or something along those lines. Whether or not they have the means to verify this with the FAA, I'm not sure and I honestly really doubt, but it would be at your own risk to not report such events to an employer if asked.
For a failed 44709 Reexamination (x2 - you usually get two shots, unless the first one was so terrible that the ASI believes you have absolutely no chance whatsoever of passing a second time) or Enforcement Action, those will turn up because the result will usually be a certificate suspension, revocation, or downgrade. Enforcement Action will likely having you talking to the FAA's attorneys in an attempt to settle the matter with a suspension or something similar. If you did something really big, illegal, and intentional, you're probably headed to the NTSB judges eventually, though they're backed up years because they handle all of the Department of Transportation cases and not just the FAA. They also do so with only a handful of judges.
So really, an honest mistake with today's FAA isn't that big of a deal so long as you weren't intentionally violating regulations, and you're willing to talk about what happened and why it's not going to happen again. The ASI will appreciate your cooperation in quickly clearing another PD off his task list, and you can get back to flying without the trip to jail.

FAQs

Why are pilots so afraid of this process, then? If you're not lying, it doesn't sound so bad.

The "old" FAA didn't have the Compliance Program. The only tool in their toolbox was a hammer (Enforcement Action), and every violation or other problem was a nail. Any little mistake that a pilot made did carry real jeopardy that their certificate was in danger. Obviously, that didn't foster trust that the FAA was really there to help, because they often weren't. There was also a time before ASRS/ASAP reporting and other programs which reduced or eliminated the penalties in exchange for information sharing. Essentially, the FAA finally figured out that if they wanted to improve aviation safety, they needed honest and accurate information from pilots. Pilots weren't inclined to share information if it would be used against them and enforcement was the only outcome. Programs were created to remove the consequences of an unintentional violation, and those are now the primary ways that deviations are resolved. Many pilots are still afraid of the "old" FAA, even though in practice it no longer really exists.

Do I need a lawyer to talk to the FAA or ASI during an investigation?

No. If you have access to one at no cost through another benefit like AOPA or employer insurance, go for it. However, lawyers just become an intermediary to work through, especially for simple deviations. If you want to minimize consequenses, you're going to personally talk to the ASI and you're going to openly share information about the event. A lawyer can't get you out of an investigation or the outcome, because they can't override the very broad 49 USC authority that the FAA has been given in both investigating and reexamining airmen. If you know for sure you're looking at an Enforcement Action, you can still settle with the FAA attorneys on your own, but a laywer at that point is up to you. Heading to NTSB court? Yeah, lawyer up, because you done messed up now, A-A-Ron.
You are always free to retain a lawyer and direct the FAA to communicate with them at any time, and most ASIs really don't care one way or another, but I would say it's an unnecessary expense if your deviation was an honest mistake. Do whatever makes you feel better, though.

Should I really talk to the ASI during the investigation? This seems like a trap.

As explained, the Compliance Program is only an option if you're willing and able to comply. If you're not willing to openly and honestly talk about the event, you're not really willing to comply. The alternative if you are determined to have violated a regulation is Enforcement Action, soooo... your choice!

What if I don't want to disclose everything to the ASI? What all do they know/have access to?

More often than not, the ASI has the ATC data regarding the event. This includes the radar data and ATC communications. They can play back the portion of your flight in question, so they can see where you actually were, what you were actually doing, and what was actually said. They of course also have access to the FAA databases for your certificates, medical, aircraft, and prior contact with the FAA. I wouldn't suggest lying about any of that.
An ASI reviews all of this before reaching out to you, so usually your conversation is just to fill in the gaps and figure out what was going on in the airplane from your perspective. If I can see or hear from ATC data that you took a wrong turn during taxi and then were embarassed about it before I even talk to you, I probably just have one or two gaps to fill in as to why it happened. Otherwise, unless this is the third time you've come up on my desk this year or you tell me something really abhorrent when we talk, it's almost certainly going to be a Compliance Action Counseling conversation and then good day, sir.

What about the NASA ASRS report? Doesn't that get me out of jail?

Kind of - honestly, an ASI typically isn't even aware if you filed one, or what the status of that is. It would likely come into play if you were facing Enforcement Action. Filing a report will not guarantee that an investigation does not occur, or that you will not need to talk to an ASI. It only guarantees that you will be immune to civil penalties or certificate suspension if you file a report in a timely manner, and you weren't doing something illegal. The information in your report also can't be used for enforcement purposes. That said, if the FAA finds out about a potential violation a month later, and you knew about it but didn't file a report, you generally can't go file one after the fact as an oopsie-daisy to try to avoid the consequences. If you suspect you violated something and you're worried about it, it never hurts to file the report. And as explained above, unless you were grossly deficient or intentionally violating a regulation, you're probably only looking at Compliance Action either way.

I received a Letter of Investigation. Am I in more trouble than just receiving the CP & PBR Brochure? What's the difference?

Not necessarily. You're supposed to receive the Pilot's Bill of Rights in some form before the FAA talks to you about an investigation into an event in any substantial manner, regardless of the nature of the investigation or what the expected outcome is. The LOI is required to be sent to you prior to any Enforcement Action, so some ASIs/offices send out LOIs for any report of a Pilot Deviation just in case something is discovered which pushes it into enforcement. Both the Brochure and LOI contain the required Pilot's Bill of Rights notification, so either one works from the ASI's perspective of simply being able to talk to you about the event. The LOI does inherently come off as more intimidating, though, as it's more formal and on the FAA letterhead.

An ASI randomly handed me a CP & PBR Brochure on the ramp, at an air show, etc - am I in trouble?

No, unless they wrote something in the brochure indicating something specific about a potential violation. ASIs are supposed to share the brochures to raise awareness of the Compliance Program whenever they interact with pilots.

I had a bad interaction with the FAA where _____ happened, and it was nothing like what you said.

Sorry about that. Like I said, not every office is the same. Generally, ASIs want to use the Compliance Program to get things out the door where they can. Maybe you got a grumpy ASI, or their office had seen that sort of thing a lot and was cracking down, or there was more to the story. Like any organization, let alone being the fed, there is some inconsistency between regions and offices. Every ASI I personally knew would have done their best to be fair and to follow the CADP (Compliance Action Decision Process), which I more or less explained in the sequence of events above.

I have another question about what the FAA would or wouldn't do.

Feel free to post it or DM me - I can't guarantee any specific course of action or outcome, and I don't speak for the FAA officially, but I might know some stuff about things regarding your Q.

Synopsis: After spending a year in prison for a heist gone wrong, a thief's attempted reunification with the daughter he lost embroils him in an unexpected adventure.
Great movie. Reminds me of the Indiana Jones movies from when I was a kid. Just a good old-fashioned adventure full of fun, interesting characters with solid story arcs and a perfect blend of humor, heart and action in a fantasy setting. Chris Pine is always great and does a fantastic job as the reluctant thief leading his band of classed characters. Michelle Rodriguez plays the same character she always plays but it works well here as she is the troupe's warrior. Justice Smith's inexperienced wizard provides a lot of the comedy and the changeling character played by girl is a fucking hoot. Owl Bear for life!! The villainous sorcerer Sofina played by Daisy Head is appropriately terrifying.
I really would not have expected to a Dungeons & Dragons film to be so entertaining. Like, I know it has the potential to be awesome but Hollywood has a way of fucking up a sure thing. And yet, this movie was a lot of fun and hit the right notes all the way through. The comedy works very well without the oversaturation that's so problematic with the latest batch of Marvel flicks. The action is top notch with at least three scenes that I was super invested in and the variety of characters throughout assists in the immersion as well. Additionally, my D&D days are pretty far behind me so I'm sure I missed several references but even with my atrophied comprehension a lot of the in-jokes hit with me. I loved just about everything about it. A definite watch.

2023.05.28 18:07 TobaccoEarlGrey Just got off Arvia P&O

Yo!
I’ve just spent two weeks on P&O Arvia, a pretty new ship so reviews / reputation a bit thin on the ground.
It was pretty hard to find good food or service on the boat. So here are a few useful food notes/hacks for anyone travelling on it, but also feel free to AMA in the comments, happy to share anything else that would actually be relevant or useful for you.
Worth saying: My first cruise. Pretty cool being on the ocean and spending time with my recently widowed grandmother and some of my siblings. But it’s not my kind of holiday, or maybe just not my kind of cruise / boat / company!
  1. Glass House
Impressive, adventurous wine list at good prices with good food. Peruvian Malbec, a marvellous Assyrtiko, some ridiculously cheap vintage English sparkling. Interesting small plates. Also had the same small group of staff so easy to build a good professional rapport e.g. free drinks, extra measures, interesting conversations (initiated by them) etc. Obviously the prices are subsidised by the overall cost of the cruise but for £7 or 8 you can buy a 250ml glass of something fairly special that'd cost you £12-17 in a restaurant back on land.
  1. Horizon Buffet
At first impression Horizon, the main buffet, looks and feels like Dante’s eight circle of hell for all manner of reasons, BUT, it actually turned out to have a couple of hacks which made it a great option sometimes.

  1. If you like cooking / making your own food at home, this is the closest you'll get with some great selections of interesting salads, raw and steamed veg, oils and fish. Build your own actually nice meal... for those of you whose idea of holidaying well also includes eating well.
  2. Take your food and leave the main indoor Horizon tables behind you, sit on the tables on the outside deck out the back of Horizon, towards the infinity pools, under cover, for a cafe terrace feel
  3. Use your napkin as a small table cloth (like when you’re on a plane and the cabin crew lay your meal out for you)
  4. If you’re with a group, set your table out like above and then take a few trips into the buffet to get bowls of salad and side dishes to eat like you’re eating a half decent social meal at home. You’re also then right by the outside bar on that deck so easy to order a couple of bottles of wine for the table.

  1. Quays
Grab your chips and head to the sunset bar
  1. Green & Co
This restaurant was pretty much always empty, even when the other ones were booked up. It was the healthiest, nicest presented and delicious food I ate on the boat. The Sushi component was also some of the highest quality fish and preparation I’ve had outside of actual Japan. Yet still, pretty much always empty.
  1. Meridian and Zenith
The two ‘posh’ main dining rooms (included). Stylish interiors and smart waiters but the food was bland and the service was slow. All the food tasted the same no matter what it looked like. It’s meant to give the vibe of fine dining but the implementation just isn’t there.
  1. Service is weird
Service is slow, and weirdly for all of their ‘luxurious dining experience’ marketing there are never any things on the table like bread, olives, anything to stop you getting slightly pissy about the consistently slow service. There are a few little things like this.
For example, if you eat breakfast in Meridian or Zenith, they put jam on your table the moment you sit down but someone only comes round offering a rack of toast once you’re halfway through your ordered a la carte breakfast which comes half an hour after you’ve ordered it.
This sort of thing was a consistent occurrence, and others like this, which either means they want you to feel like it’s a ‘here’s a posh rack of toast’ kind of place without actually wanting to give it to you, or they’re just a bit crap at systems and haven’t really experienced it for themselves.

Anyone got any thoughts/experiences on the above? AMA about the ship or experience too if helpful for ya.

2023.05.28 18:07 C-Brooks-C Looking for something advernturey I can kick back and play with a controller.

I'm looking for something open world with adventure that I can get immersed in. I want something other than the story that I can work on too, a business venutre, a home I can work on etc, something to give the adventuring some meaning. I do really love tycoon/managment games and I would love a balanced economy or something I can dig into while adventuring.
I've played Kingdom Come Deliverence and the From the Ashes dlc.
I've been playing The Witcher3, but that's more focused on story so I'm enjoying that in stretches.
Medieval Dynasty is on sale and that looked kinda like it might be in that area but I worry about the quality of it from reviews.
edit: forgot to mention RDR2, that was great, upgrading the camp etc but felt a little lacking there.

Any input appreciated, thanks.

2023.05.28 17:37 nyooomy EX04 Gift box happening?

I couldn't find anything about it, so asking here. We got a Gift box set for the EX01 set back in December of 2021 (GB-01), and an Adventure Box Set with EX02 packs in July of 2022 (AB-01), and another Gift Box with EX03 packs in November 2022 (GB-02).
Will we get something similar for EX04? It's releasing next month and I feel like we usually get a reveal of these boxes months in advance.

How do these people have five stars and get promoted?
I do not understand Rover’s algorithm. This person appears much higher in the search results than me and has these reviews at the top of their page… an apparently hasn’t done a job since August of last year (at least, one that has been reviewed.) their calendar hasn’t been updated in two months.
Conversely, I have a ton of recent jobs and reviews - all five stars - repeat clients - updated calendar. In terms of the number of reviews and repeat clients, they have slightly more than me, but obviously, much lower quality. I just don’t get why Rover even allows these people to remain on the app, let alone promotes them.

The Primeval Apocalypse by Robert Keene and Alex Raizman

I regret saying I'd skip coffee today...

After getting both Rachel and Jennifer on board with the plan, she pulled me aside to get me a weapon upgrade in the small window of time while she explained everything to the others. To that end, she introduced me to a laconic teenager who—despite his attitude—could confidently claim to have the highest Crafting (Weapons) skill in the camp.
With his skill and the abundance of iron, the weapon was automatically going to outclass whatever I could expect to loot, but I did have a choice of customization. I had collected four weapon materials in my adventures, and offering one of them to be used in the crafting would add a little spice to the result. I reviewed my options.
Pelagornis Jawbone Weapon Material, Armor Material Weapon Material Properties: Weapons crafted with this bear the Pelagornis’s needle-sharp teeth. Applies a bleed effect on hit. Armor Material Properties: Armor crafted with this benefit from the Pelagornis’s lightweight bone structure. Increases DEX and AGI.
Armored Pithecus Teeth Reagent, Weapon Material Reagent Properties: Boosts DEF. Grinding required. Weapon Material Properties: Increases DEF while equipped.
Sturdy Dimetrodon Jaw Weapon Material Weapon Material Properties: Weapons made with this bone inherit the dimetrodon’s tenacity. When dealing damage, temporarily increase the wielder’s parrying skill.
Terrorbird Feather Weapon Material Weapon Material Properties: Weapons decorated with these feathers inherit the swift spirit of the Terrorbird. Increases the wielder’s attack speed on hit.
I was immediately attracted to the Pithecus Teeth or the Dimetrodon Jaw to give me a little bit more of an edge on survival, but I had to put that idea aside for now. With Rachel and her crew on hand, I wasn’t going to be the primary frontline. Not to mention that level 8 hadn’t been kind to me in terms of offensive tools. The Pelagornis Jawbone or the Terrorbird Feather were going to be smarter options to improve my damage output.
In the end, I handed the crafter the Terrorbird Feather. As a dual-wielder, attack speed was potentially much more valuable to me since it should apply to both weapons even if only one of them had the property. Plus, I had a hunch that attack speed was going to be critical to building achievements on my new Teamwork IV passive.
“Where’d you get these?” the smith asked even as his hands were busily integrating them into the construction of the axe.
“Oh, I just found them,” I said with a grin. “It’s funny the things the Mandrills just leave lying around in the forest, attached to the skin of giant murderous bird-monsters.”
The crafter was unfazed by my joke.
I decided to let him concentrate on his work, heating and hammering the smelted iron, turning it red and then smashing it into shape until that hot glow turned dull, and then returning it to the heat to start again.
Despite his youth, every movement had the confident and lazy precision of a master crafter. I tried to make conversation, but he was either too antisocial or too focused on his task to respond.
When he was done, the weapon itself was fairly simple in design—a crescent-bladed iron axe attached to a hide-wrapped wooden haft. But the terrorbird feathers served to decorate the weapon, giving it a slightly wilder aesthetic. Two of the feathers had been used as guides for etched designs on either side of the axe head, while several more had been affixed to the weapon around where the haft was attached, creating a brownish feathered fringe. The smith worked for just another minute to deftly grind down and sharpen the edge of the weapon before handing it over.
“Bring more of those feathers if you can,” the smith said with a shrug. “I can try for a high-quality crafting check for you. And I can think of a few others who would like this property.”
“If this isn’t a high-quality crafting check, I might lose my mind if I see one,” I marveled, examining the weapon. “I don’t have words for how grateful I am for this.”
Iron Axe of Celerity DAM: 45 DEL: 12 +2 CON +2 STR +8 Axe Additional Effect: Increase personal attack speed by 5% for 5 seconds on hit. Stacks up to 5 times.
It was so much more powerful than what I was using, I almost asked him to make another on the spot. But before I could try and formulate a way to make it seem reasonable, Rachel reappeared to pull me away. The raid crew had been briefed on the plan, and received their orders. Everything was in place.
It was time to go.
***
Marching on the Mandrill town was the easy part, made all the easier by the tools available to us. The scout—whose name I finally learned was Emma—could spread buff called Wind Walk to the whole group, which included a movement speed boost and the same semi-invisible state of Hide In Plain Sight, which several of the other raid team members hadn’t earned.
Rachel wanted me to incorporate a hit on the northeastern camp on the way in, and I hadn’t been able to talk her out of it while we’d been in camp. Bringing the team to a halt for a few seconds so that I could scan the area with Beast Hunter told me what I needed to know to move us on without delay.
“They’re massing here,” I warned.
The camp was much like the one I’d hit before. A small makeshift pen and a handful of tents. Only enough space to really support a half-dozen mandrills for any length of time. But there were nearly thirty fighters assembled here now.
“Should we be afraid?” Rachel asked. “Are they going to go after the town?”
“Not a chance,” I said quickly. I pointed, even though she couldn’t see what I could see. “No mounts. Just two terrorbirds and a young dimetrodon. Probably for running messages. They aren’t here to launch an offensive. They’re here to defend against our response.”
“Not our response,” Rachel pointed out with a smirk. “Yours. You’re the one who spanked them and sent them home.”
I took a closer look and picked out the Mandrill wearing the reed mantle that marked her as leader. In addition to the mantle, she had a pair of poultices on her ribs, covering wounds that I could tell from here were deep. She was anxious. Fidgety. With her at the helm, her obvious fear was infectious. The whole camp was filled with tension, even though the Mandrills here outnumbered all the humans under Rachel’s command, let alone her dozen fighters. Her grip on her poleaxe was white-knuckle tight.
“The survivor,” I said, spitting the word like a curse. “They put her in charge of holding me off if I came for them again. She was so terrified she raised a damn army.”
Told you, Noaich muttered. Wasn’t smart.
“I told you,” Rachel said at the same time, “leaving her alive wasn’t smart.”
“Yeah, yeah.” I waved my hands dismissively at both of them. “But I think you fail to see the advantage here: as long as we get in and out faster than a runner can get here and back, this is an army that we won’t have to fight to achieve our goals. We’re not stopping them by taking out their fighting force.”
A spark of understanding grew in Rachel’s eyes. I sensed a similar adjustment in Noaich’s body language.
“We’re cutting the line,” Rachel said, addressing the group. “Get moving. And be ready. We’re not going to be able to issue your orders on the spot. You need to know what to do as soon as we make contact.”
“No room for mistakes,” I added as we started moving on.
We circled wide around the camp, staying well out of range of any detection that they might have at their disposal.
The army wasn’t the target. Not by a long shot.
After getting clear of the camp, we cut straight west, heading straight for the Mandrill town beyond.

2023.05.28 16:56 sclkoma Open Letter to the DOTA 2 Community Regarding My Permanent Ban from the Competitive Scene

Hello everyone. My name is Kamil "Koma`" Biktimirov, I’m 20 years old and I'm a professional Dota 2 player who was banned for account sharing in December 2022. I'm writing this post today to express my deepest regret for my actions and to ask for consideration in reviewing my case. I am hoping this post gets enough attention so that it might reach PGL and Valve but more importantly I want to shed some light on the situation.
Firstly, I want to say outright that I accept full responsibility for my actions. I was involved in account sharing, and it was an enormous mistake on my part. I won't make excuses for my behavior, but I want to assure you that I was not fully aware of the gravity of my actions at the time. I now understand the damage I've caused to the integrity of the esports scene and the trust of everyone in the Dota 2 community.
Please allow me to explain the situation and my actions. In September 2022, I played for team Luna Gaming in a tournament called Dota 2 Champions League (D2CL). One day, my manager, Lil_skrip, told me we had tournament games to play on 22 September, although there were not supposed to be any games on that day based on our team schedule. He then told me that I needed to play from the account of another person, who was in team S9, participating in that same tournament. I was unsure about it, but I was then told that this was only for us to get more games to use as practice for more competitions in the future, and that no match fixing was involved. I was naive, so I did not think any further and said okay, and went ahead to play since it was just more practice for me. Suddenly, I saw news about 10 banned players, with myself being included. After this, I found out more about this situation, and realized that some players received money for those games. I was not persuaded to play on the basis of money, just practice, so I did not receive any money from this incident which I can prove with bank statements. I have since washed my hands off of this issue, but some others who were banned alongside myself were found to have committed more offenses, namely Kirill “deihra” Haritonov and Yaroslav “Limitless” Parshin. They were found to have played with fake nicknames and fake accounts in EU DPC Qualifiers, stuff that I am 100% not involved in. (https://cyberscore.live/en/news/lefitan-mog-igrat-za-swat-ix-vchera-diskvalificirovali/)
I now fully understand how severe my actions were. I was very naive and I am sincerely regretful for what I have done.
Dota 2 is my passion, and nothing can replace it, and I am fully committed to doing whatever it takes to prove that I deeply regret my actions and making amends. I hope that the community is able to forgive me as I did not act on malicious intent or financial greed, I am just a kid who wants to play Dota. Moreover, this is my first and only offense, and I can promise that I will not repeat the same mistakes.
Since the ban, I've reflected on my actions, and their severity. However, I have not given up on my Dota 2 career and have continued grinding MMR (currently top 30 ranked in EU servers at 11000+ MMR). I am still playing in order to improve as a player, and I have taken up streaming on Twitch to stay in touch and involved with the Dota 2 community. (https://www.twitch.tv/sclkoma)
Dota 2 has been a major part of my life since I was 13 years old, I have nearly 20000 hours in the game and more than 15000 games. It will continue to be a major part of my life regardless of the ban because I just simply love Dota. I just hope to be given a second chance to fulfill my dream of a professional career in Dota. Just as I had the opportunity to properly partake in the professional scene, my life was turned upside down because of a severe lapse of judgment on my part. I am young, and I cannot express how deeply regretful I am for my actions and how much despair I am in due to the severity of the punishment. It took me a really long time to accept and deal with this situation and it has already been 5 months since the ban.
There have been other players in the scene who were given second chances in the past and have grown to be an integral part of the Dota 2 esports scene, such as Noone (account sharing) and Solo (match fixing) who are now regarded as Dota 2 legends. I just ask for empathy and forgiveness for my mistakes. I greatly hope to be able to continue my career in the future.

I used a pre-made resume template, and I stumbled my way into making the social entrepreneurship section, however I cannot figure this out. Thank you for your help!!!!

2023.05.28 15:46 MGK_2 I Tell You A Mystery

I Tell You A Mystery
Welcome here folks. It becomes a little too obvious to me on what is going to happen. It is not if, it is when. Let's reveal the thinking on why I say this. It all goes back to the Mystery on the 2022, mid-summer daydream run up. We are living in strange times. You don't need me to tell you that. From the surface of it, it appears as if we are going to hell in a handbasket, it is almost as if we are about to fall off a cliff, however, that hasn't happened, at least not yet. I get it, though at times, it may seem that I don't. The things we have experienced holding this stock are not normal, but neither are the times.
In the long term, Leronlimab shall become the CCR5 blockade of choice, the Gold Standard. That shall happen. It will be written into the medical journals and text books as the monoclonal antibody which cured humanity of HIV and shall become the standard of care in NASH and metastatic malignant tumors. Many of us here already know that this shall happen. So, I wanted to know more about Leronlimab and in order to explore LL, you need to know the company CytoDyn behind it and so I put together this page to help me understand them.
Both myself and a buddy of mine who you also may know, u/psasoffice do come together on occasion to lay down the dirt on that what it is. Today then becomes another instance of yesterday's conversation. I say this to say that in much of what follows, I am the messenger. The bike messenger who picks up the package, reads it while I peddle along, and then deliver it to you soon after the discussion. And let me tell you, u/psasoffice puts together the pieces, a puzzle master where no plot or twist is beyond his x-ray vision. As a matter of fact, He has been behind much of what I've written for over the past 6 months now; it might have been since October or even September of last year, when he sent me something which peaked my interest indicating that he liked what I was putting down, and then, with his perspectives and insights, it just kept expounding. You can see what I've written here , but somewhere around this post , I began talking with u/psasoffice and many of the articles thereafter have his influence.
There were many indications or hopes set that the hold will lift by a certain date. That didn't happen. It has been my notion, (not necessarily u/psasoffice's notion, but it may be), that when we see that Peace and Safety become raised of concern, then it shall be then when the hold lifts. Well, next week, America may default on its debt so then, the markets could quiver. That could lead to unrest. What I've said is that when there is rampant havoc & distress all around, and the masses screaming for Peace and Safety, so it is then when things shall begin for CytoDyn. I said it before and I'll say it again, that when this time arrives, we best remain still, stalwart, confident and quiet. We have seen the signs of where we are headed, and know, we have arrived, we are there. We have taken the exit off the highway and are nearing our destination. Therefore, when the strong winds blow, take a strong, solid and stout stance and know, that this moment was just one of the reasons why you bought your shares. This Initiating Juncture and the events which follow the triggering event of lifting the hold are not that far off, but rather, they are right around the corner. Actually, we have reached the destination, so get out of your car, take a breather and stretch. Shut your engines off. We are there. We did it. We've reached that point. Patience is a virtue. I sincerely appreciate all of you on this difficult journey together.
We have been living the same day again and again, like its Ground Hog Day over and over. All of us have been under the impression that all has been done. That all has been submitted. We understand that no more than 30 days should pass from the day the last submittal was sent before a Result is issued. However, we have the same lack of result day after day. Such a grueling process, what does all of this mean? It means that we have gone through the required process for so long and have paid a huge price, but despite becoming emaciated and haggard, we have finally arrived. Our heads were forced under water by manipulative hands for so long, fighting us against our wills to survive. Finding ourselves running out of air, we finally break free from the over whelming strength of that grip and take that needed breath. Those still here after so long shall find the answer they seek since their desire for this answer is as much as their desire for that breath of air. A Breath of fresh air is well worth the wait when forced underwater indefinitely, outside of your personal control.
Just 2 weeks ago, Cyrus took a leave of absence due to illness. Cytomight sensed he had something going on, but he probably was trying to stick it out, but in the end, he had to leave and now requires time to recover. Lets hope that when he recovers and is able to return, that the Result is already in by then. We already know that the Result shall be a positive one. Lets hope that on the day which he returns, that the NDAs, partnerships & collaborations which are all contingent on the hold being lifted have all or some, been already signed and activated, thereby allowing Cyrus to return as CEO. Wait! How can these agreements be signed if Cyrus lies in bed? Oh yeah, I remember now, we do in fact have an interim President Antonio Migliarese who is already versed in the signing these official agreements. What a Team Cyrus has put together. I love the profound wisdom of this strategic team and proud to own a part of it.
We recently got some awesome news in the way of CytoDyn's newly hired CMO, Dr. Melissa Palmer, who is nothing but a NASH specialist and long time expert in the field of Hepatology. Also, CytoDyn hired Dr. Salah Kivlighn, who has a rare blend of science and business acumen and has 15 years tenure at Merck & Co. What does that tell you? NASH is CytoDyn's #1 indication. Management at CytoDyn has been communicating that NASH is #1 on the docket for clinical trials since the time that Cyrus came on board, because it was his team which established NASH as having the highest revenue potential. Cyrus has been telling shareholders that NASH is to be CytoDyn's own, that is, without partnership, but this is becoming increasingly more difficult to adjudicate.
If CytoDyn does in fact have a clinical trial for NASH in design and development and in the running, then the Mystery of which I speak is, how does CytoDyn pull this off?
Lets look at some of the details. A Phase 2 clinical trial for NASH would be pretty expensive ($35-50 million) and large, (150 to 200 patients) and it could take 12-18 months before we see any results. In the 12/7/22 R&D Update, Management stated that they had hoped to initiate it by 3q 2023 and to be fully enrolled by end of 2023.
As a reminder of the 12/7/22 R&D Update Investor Deck found here. :
Slide 98
  • 1:31: 40: So in terms of what potential time lines can look like, I think it's really important to highlight that from a value-creation standpoint, and I've mentioned this before, we truly do need to generate a large robust and what I call unequivocal data set that will leave no questions left on the table, right? And that a strategic partner would find attractive and attractive enough to do a real value-accretive deal with the company.
  • 1:32:14: And so we've gone through and knocked out what the potential time lines are across each of the different areas that we presented on today. And we're -- as I mentioned before, NASH & Oncology are our priorities. However, because this is all going to be funding dependent, we're going to focus on NASH initially and work with co-development partners to the extent that we can to develop in oncology.
  • 1:32: 44: So what do we expect in 2023? So our largest priority is the removal of the clinical hold in HIV. This is essentially a gating step for us to be able to get back to normal operations as a company and do what biotech companies do, which is advanced therapeutics and try to bring them to market.
  • 1:33:10: Following the lift of the clinical hold, we expect financing to fund operations and to achieve this value inflection point that I've just alluded to. We intend on initiating a new NASH trial. We would like to commit to an investment in and advance longer-acting CCR5 molecules, as this is potentially the future of at least certainly HIV therapy, as Dr. Sacha presented.
  • 1:33:35: We continue to contribute in medical meetings and peer-reviewed publications. Again, the CD02 trial data is in process for that right now. We're going to continue to reshape our team and our capabilities in order to meet our goals. And at some point following the achievement of earlier metrics listed on the slide, we're starting a corporate rebranding as well.
Now back to what I was saying about the large and expensive clinical trial for NASH. What about the problem of recruiting the patients? There is huge demand for these patients. There is a lot of competition here. NASH patients are like gold to enroll as so many Pharmaceuticals compete for those patents for their own NASH trials. How does a small Biotech, pre-revenue company with only $5 million in available funds pull this off? Not only paying for the trial, but how can it show itself as having the clout required to round up those patients in a rapid way? My feeling is a partneCRO needs to be involved somehow.
First off, we know for sure, that the NASH clinical trial will not be entered into until the hold lifts. Once the hold lifts, we can expect near immediate revelation of how this will be accomplished. But, we can speculate as to how this will get done. u/psasoffice suggests that if we follow the money, we can find our answer. But you might ask, What money? We don’t have any. So then, what if we follow the share price?
Remember back to mid-summer 2022, when Cyrus was hired as President, share price was low and even fell following his hiring, but soon thereafter, in late July through August of 2022, the share price rapidly rose to $1.26 per share and then progressively diminished once again over the course of ensuing 6-9 months to where it is today.
Lets take a look at this so we can get to the secrets which will be revealed, where we can open the doors of the collaborations. You may ask, How did we get someone to accept a collaboration? When were the collaborations accepted? Along with Mazen Noureddin and Jonah Sacha, Cyrus presented the R&D Update Investor Deck on 12/7/22 and he was able to say all the things which were said then 6 months in advance and he said them essentially in a DEFA14A SEC filing. The forecasts made in this document and in this presentation were filed with the SEC in an 8-K.
So then, how long before Dec 7 did Cyrus know that the very things which he would plan for the company which he wrote about in the Investor Deck were so very possible to file it with the SEC? Let's say he knew of the strength of his forecast say 1-2 months in advance. Therefore, by mid October he was aware of secret agreements, Cyrus must have known of specific collaborations which would allow those prognostic statements to be made in the Investor Deck, but which were predicated upon the hold being lifted. Therefore, How long did it take Cyrus and collaborators to sit down and make the agreements of NDA? Again, another 1-2 months? So by August, 2022?
Now you can see why the share price inexplicably rose in July / August, 2022. A Collaboration on a NASH clinical trial occurred which also explains the result of these words spoken on 6/30/22 Conference Call by Scott Kelly after his trip to EASL in London: "37:10 Scott Kelly: OK, so we certainly acknowledge being more metered and conservative in our publicity. We will be announcing important presentations and studies on a going forward basis. Regarding the NASH, about how NASH attracted partnerships*, we just presented the PDFF and cT1 and biomarker data at* EASL in London*, just to shed some color on the importance of the EASL meeting, there were over* 7,000 delegates present or online from 114 countries*. There were* 1,722 abstracts presented*. There were only* 4 poster presentations selected for a walking tour with the chairman at EASL. And We were one of those 4*. I was present and I can tell you, it was* well received by the scientific community*. We* can not comment on potential partnerships. But there are multiple opportunities for NASH and NASH HIV."
What also happened in August? Only the removal of the first management player who’s experience was in Negotiation and Partnerships, Brendan P. Rae. No longer any necessity for Negotiation? I guess not. As time went quickly by, without any word of what was taking place, the share price began to fall. It became uncomfortably obvious that by mid November, Recknor had been let go. He was CytoDyn's most experienced scientific, medical and managerial player for NASH, but in the game of a collaboration, anyone and everyone is a commodity and all are replaceable. On the same topic, a significant stock bonus was paid to the president in September of last year after only two months on the job. Was a deal struck? Also, our very own CMO, Scott Kelly who coined the phrase: “There are many ways to structure a partnership.“ himself gets terminated in December 2022. A CMO possessing far more experience in the #1 indication than he could ever have was already being eyed and prepared to take that role for the biggest proving ground party that will show that Leronlimab eradicates steatosis and fibrosis in NASH and NAFLD. Welcome Dr. Palmer.
Once the NASH deal was struck in July/August, it wasn't long before the share price began to rise but just as quickly, it fell as well. Rumors of a partnership must have gotten out, the price ran way up, but then later, in late August, down it went. The stock price dropped because there were no announcements by either party backing the deal. That’s due to the fact that it is contingent on the hold lifting and that it could be a year out before this collaboration moves forward. The collaboration was put on hold along with the clinical hold. It was not revealed outright and therefore, shareholders were not aware of it, but it still exists and therefore CytoDyn remains confident. It is not a traditional partnership, but rather a non traditional one which we may use to answer the questions of how can the NASH trial be funded and how can CytoDyn have the utter confidence to put together such a timeline for proceeding in such a large scale Phase 2 trial in NASH without possessing the necessary funds itself.
How then can we define a Non traditional partnership? CytoDyn will not get a large upfront payment. Instead, CytoDyn continues on its own, however, all the CRO work shall be done by our collaborator. What’s is in it for the collaborator? They run the NASH trial because they believe Leronlimab helps their drug get over the finish line. But Cyrus was saying NASH would be Leronlimab monotherapy and wouldn't be combination therapy. CytoDyn just can't go it alone, it is too small, and a hard luck story company which has failed in its history thus far at every turn. For NASH, u/psasoffice is thinking GSK, while I'm leaning towards Merck.
All of us know that Leronlimab could do it alone in NASH, but that’s not how the Pharma game is played. CytoDyn needs help, and it has 4 different plays, and each play is devoid of a deep enough data pool which would bring in funding for that indication. Cyrus' long term goal is to build out a strong enough clinical trial data pool to present it to a partner or a buyer. So then, without any cash of our own, Cyrus' plan is to have someone else's funding, partner with CytoDyn and build for us that data pool and in the end, have exactly those same partners compete for the entirety of it, for the whole or part once that data pool is firmly in our grasp.
The same story goes for HIV-Prep and HIV-Cure which is probably being run by the 3rd party Research and Development Bio-Tech company Vir, in collaboration to develop the long acting or a more longer acting molecule of CCR5 blockade. Vir is pretty much a given with Scott Hansen's strong connections there. This was kept secret, but somewhat hinted at by Cyrus in the 4/11/23 Webcast .
We can apply the same logic in the Oncology study being run by MD Anderson using Merck's Keytruda in combination with Leronlimab. We had all been waiting to find out what had happened with the results of the MD Anderson study, and Cyrus threw us this line: "Leronlimab is currently being trialed in combination with Keytruda (pembrolizumab) in a breast cancer xenograft model in partnership with MD Anderson Cancer Center." From here, he gave us a hint of what is to come.
It can be assumed that as these collaborations are announced, there shall be share price inflection. In his astute fashion, Cyrus has given us the secrets, but, because of these strange times, the share price has not yet moved. But what it has done is it has held us here, because we are above the times. And we may be seeing a default on the debt in the coming week as well, but remember to remain strong.
CytoDyn knows its has a problem. Therefore, while our collaborators are running these trials for us, CytoDyn itself, remains detached as we pursue other similar non traditional collaborations. The perishable, flesh and blood CytoDyn uses the strategy of its intellect and the power of its IP to become the imperishable CytoDynasty. As Leronlimab has many, many, many indications, so shall CytoDyn have many, many, many collaborations. This is the direction until Merck goes up against GSK who bids against TAK , (thank you Jake!!), for the likes of little CytoDyn who at that point, possesses the grand data pool which Cyrus coveted which was freely obtained in only a few short years of time well spent.
Oh Black Hole, do yourself a favor and swallow and regurgitate everything you just read. Where then shall you find your victoryzzy? I see you stabbing yourself and choking on your own stinger of death. Cyrus spelled it out for you dumb ass. Watch it happen before your blind eyes and you still will deny it even occurred. Oh, I hear it at the door knocking. But you are both deaf and blind. Why are you here? Only to be robbed and the longer and deeper you choose to remain here, the worse it will be for you. However, it is easily avoidable. Cut the short position and go long.

2023.05.28 15:45 MrsDarcy1200 Am I bad at my job?

I graduated in 2022 with my bachelor's and started working in the finance department of a small solar company. Most of my job is just categorizing transactions in quickbooks and creating bills in bill.com. I started as an intern working 20 hours/week in 2022 and this year I started working 30 hours/week. I will have been at the company for 1 year in June.
Our manager just got a monthy bonus approved for our team if we meet certain criteria each month. We each have our own criteria to meet to earn our own bonus. The bonus is an additional $375/month for the rest of this year, so $3,000 total that I could potentially earn. One of my criteria is to make less than 5-10 mistakes a month.
This feels completely unattainable to me. On a slow day, I might have 25 transactions in Quickbooks and 5 bills in bill.com. Let's say it's been a slow month and I've only done 500 QB transactions and 100 bills. So of the 600 total "events" from that month, I need to make less than 10 errors, an error rate of about 1.67%. And by the end of this year I'm expected to get my errors down to 5/month, making the error rate down to 0.83%. Keep in mind the company is growing so the average number of transactions will be increasing over time as well.
An example of an error might be that the customer name is incorrect on a bill I entered, or I entered the wrong category for a credit card purchase.
The finance director and my manager have really been drilling into me that I need to sharpen my attention to detail, and I have been trying very hard to make less mistakes. I have multiple lists of checks that I go through to try to prevent a incorrect entry, and I go through my QB transactions twice a month and my bill.com entries at least once a week to try and catch errors before we get to the month end review.
I am still making 30-40 errors a month.
About half of these mistakes are flat out wrong things that I entered and didn't catch. The other half are mistakes that I wouldn't know to catch due to my lack of experience, or the director decides she wants things done a little differently and it takes me a bit of time to get used to a new process. Like I said, the company is growing so every month there are little tweaks that are made and I find it difficult to keep up with everything.
I don't know if I should request to get this 5-10 mistake criteria changed because it's unattainable, or if I'm just a bad accountant and should take this as a sign that I'm not cut out for this.
Does it seem like I'm bad at my job or that this is a very hard standard to reach?

2023.05.28 15:29 takuonline [Show off Saturday] Went all in and hired a designer for my portfolio website

I don't work as a frontend engineer, but even in my space l think frontend skills are very important for deployment of products. In fact Mckinsey state of AI in 2022 report lists out software development as the role most hired for in AI by top performers.
Tech stack: Nextjs 13( had issues with the app dir not working with MUI), MUI, Sanity.io(blog post), deployed on Vercel.
And to summarize the skills on the website, l want to be able to build both the ai backend really well as well as the frontend really well and combine those two skills to effect positive change on the world.
Website
I wanted to hear what you all thought of the website.
